Warranty

 

Consumer Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, The Customer is entitled:

  • To cancel their service contract with us; and

  • To a refund for the unused portion or compensation for its reduced value.

The Customer is also entitled to choose a refund or replacement for major failures with goods.

If a failure with the goods or service does not amount to a major failure, The Customer is entitled to have the failure rectified in a reasonable time. If this is not done, The Customer is entitled to a refund for the goods, cancel the contract for the service, and obtain a refund of any unused portion.

The Customer is also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Warranty Information

The Company warrants that it will (at the Company’s discretion) repair or replace any equipment which are accepted by the Company as being defective or not in accordance with the Agreement or any express description or representation given or made by or on behalf of the Company in respect of the equipment within a period of 12 months on a device from dispatch of such equipment from the Company’s works ("warranty period") save that this warranty shall not apply where the defect or fault is attributable to defective materials supplied by third parties where the Customer’s only remedy will be against that third party.  The Warranty excludes consumable items such as batteries.

Unless otherwise specified, and to exclusion in cases where the equipment ceases to perform as a result of the user’s negligence or damage, storm or electrical power surge or telecommunication services issues, the warranty period against defects is:

  1. Personal Emergency Response Service (PERS) alarms: 24 months
  2. All other products: 12 months
 

In some instances, Tunstall may offer extended warranty on selected products.

Any evidence of misuse, abuse or tampering with the equipment shall void the warranty in its entirety. The Customer shall, before returning any equipment for any cause, notify the Company of the intended return and mark such equipment (or containers of said equipment) with a Faulty and Action Report form as supplied by the Company.

The Company accepts no liability in respect of any defect in or failure or malfunction of any equipment or services supplied or for any loss, injury or damage attributable, directly or indirectly thereto where such is caused in whole or in part by:

  1. The repair, adjustment and/or alteration of the equipment supplied by anyone other than the Company without prior written consent of the Company; or
  2. The installation, maintenance and/or operation of the equipment supplied otherwise than in strict accordance with the instructions accompanying the same; or
  3. The use of any equipment in conjunction with the equipment supplied where such equipment is manufactured by some person other than the Company.
 

Procedure for Making Claims

  1. Contact Tunstall Customer Service on 1800 603 377 select option 4 on the voice prompt or via email at au.customerservice@tunstall.com

  2. Customer Service will assist with further troubleshooting on the device.  If the fault is deemed unfixable and the device is within its warranty period, the Customer Service Team will arrange for a replacement device to be sent to The Customer to ensure they are not without a service whilst the return of the device to Tunstall is arranged.  The Customer can also choose to receive daily welfare checks whilst they wait for their replacement device.  Tunstall will provide a reply-paid label to The Customer for the return of the device.  The Customer will be required to package the device and return to Tunstall using the reply-paid label and the original packaging provided or an alternative appropriate packaging can be used.

  3. Faulty devices will need to be returned to Tunstall within 30 Days of receiving the reply-paid label.

  4. Devices that are not returned within 30 days of receiving the reply-paid label will incur a fee for the non-returned item.

  5. Tunstall will assess the faulty device and determine if there is a valid warranty claim on the device.

  6. Should it be determined that the warranty claim is not valid our Customer Service Team will advise on the outcome and any fees or charges associated with the invalid warranty claim.

  7. Should it be determined that the warranty claim is not valid, The Customer shall pay to Tunstall a fee for the replacement and service of the device.  This fee shall be due and payable upon invoice under Tunstall’s standard terms and conditions.

Remedies

The Customer’s remedies in respect of any claim under the foregoing express warranty or any condition or warranty implied by law or any other claim in respect of the equipment or any workmanship in relation to them (whether or not involving negligence on the part of the Company) shall, in all cases, be limited to repair, replacement, re-performance of the equipment as foresaid and any condition or warranty implied by law shall cease to apply after the expiry of the Warranty Period; and the Company shall not in any circumstances be liable for damages, compensation, costs, expenses, losses or other liabilities, whether direct or consequential, and any other remedy which would otherwise be available in law is hereby excluded except to the extent that such exclusion is prohibited by any rule of law. A claim in respect of any defect or failure to comply with the specification or in respect of any delivery or instalment or any part of it shall not entitle the Customer to cancel or refuse delivery of or payment for any other delivery or instalment or any part of the same, delivery or instalment.

Transferring Warranties

Where a transfer of product ownership has taken place, the warranty shall remain in place from the time of original sale as provided by Tunstall.  Tunstall will not be responsible should the product's warranty have expired at the time of transfer of the product.
